1. Purpose of This Policy
Our organization is committed to the highest standards of financial integrity, transparency, and accountability in all matters related to charitable giving and fund management. This policy explains how donations are received, managed, and used in accordance with donor intent and applicable law.
2. Commitment to Donor Intent
We affirm that all donations designated for a specific purpose (restricted gifts) will be used exclusively for the purpose stated by the donor. These contributions are legally binding and ethically honored as a matter of charitable trust.
Donors may give with confidence that their designated contributions will be directed exactly as intended, without diversion to unrelated expenses or programs.
3. Legal Compliance and Oversight
Our organization operates in full compliance with applicable Texas nonprofit and charitable trust law, including:
- Texas Uniform Prudent Management of Institutional Funds Act (UPMIFA) — Texas Property Code Chapter 163
- Fiduciary duties required of nonprofit directors and officers under Texas nonprofit corporate law
- Enforcement authority of the Texas Attorney General regarding charitable organizations and restricted funds
These legal frameworks require that all restricted donations be administered strictly in accordance with donor intent and organizational purpose.
4. Use of Funds
All funds are categorized and managed according to donor designation:
- Restricted Donations: Used only for the specific purpose designated by the donor (e.g., disaster relief, food distribution, emergency shelter, medical aid, or other stated purposes).
- Unrestricted Donations: Used to support operational needs, including administrative costs, staffing, logistics, and infrastructure required to sustain disaster response efforts.
- If the project has been completed: The funds then will be placed in the Combined Budget for future use.
We maintain internal controls to ensure accurate tracking and separation of all funds.
5. Financial Accountability and Stewardship
We pledge to responsibly manage all the resources entrusted to us. This includes:
- Maintaining accurate financial records in accordance with generally accepted accounting principles (GAAP)
- Regular internal review of fund allocation and expenditures
- Ensuring funds are disbursed only for approved, mission-aligned purposes
- Preventing misuse, misallocation, or commingling of restricted funds
- Keeping track of ALL donated funds and materials
6. Transparency to Donors and the Public
We believe transparency builds trust. Upon request or through periodic reporting, we provide information regarding:
- Allocation of funds
- Program impact and outcomes
- Use of restricted contributions
- Organizational financial summaries
We are committed to openness in how donations are utilized in service of disaster response and humanitarian aid.
